Sexual Violence & Harassment Policy

Principles & Prevention

The Ontario College of Health Care & Professional Training (OCHCPT) is dedicated to fostering a safe, respectful learning and working environment free from all forms of sexual violence, harassment, discrimination, and exploitation. In accordance with the Ontario Career Colleges Act, 2005 and Ontario Regulation 415/06, this policy applies to all students, faculty, staff, service providers, visitors, and clinical placement sites.

OCHCPT proactively prevents sexual violence through mandatory annual training for all employees, student awareness orientation programs, and ongoing community partnerships. The college strictly prohibits retaliation and protects individuals who report incidents in good faith from discipline related to drug or alcohol infractions occurring at the time of the incident.

Reporting, Support & Resolution Process

Individuals affected by sexual violence can access immediate support, safety accommodations, and medical assistance without being required to submit a formal report. Formal or informal complaints may be submitted to the Administrative Department, the College Director/President, or a trusted faculty member within 20 days of an incident. All disclosures, internal investigations, and resolution proceedings are strictly confidential, unbiased, and conducted with a trauma-informed approach—prohibiting irrelevant questions regarding a student’s sexual history or expression. Parties have the right to an support person during proceedings, interim safety leaves, and a 14-day appeal process for final decisions. Violations result in severe disciplinary actions, including student suspension or immediate employee termination and referral to law enforcement.

Expulsion Policy

Outlines student removal and disciplinary measures. In the event of any conflict between policies, the Sexual Violence & Harassment Policy explicitly takes precedence over the Expulsion Policy.

Occupational Health and Safety Act (OHSA) & Workplace Harassment Policy

Governs health and safety standards in the workplace, including duties to address hazards, report imminent life-threatening risks, and address workplace harassment or violence affecting employees.

Personal Health Information Protection Act (PHIPA) & Confidentiality Policy

Regulates the privacy, collection, handling, storage, and disclosure of personal health and sensitive data gathered during complaints or homeopathic medical evaluations on campus.

Ontario Human Rights Code Policy

Establishes protections against harassment and discrimination based on protected grounds including sex, race, gender identity, gender expression, sexual orientation, age, religion, and ability.

Freedom of Information and Protection of Privacy Act (FIPPA)

Dictates how personal identification data and institutional records are collected, stored in locked cabinets, and disclosed to external bodies or public entities.

Bill 132 (Sexual Violence and Harassment Action Plan Act, 2016)

Establishes mandatory institutional requirements for postsecondary schools in Ontario to maintain annual aggregate statistics, conduct 3-year policy reviews, and provide accessible reporting procedures.
